General Terms and Conditions (T&Cs)
§ 1 Scope These T&Cs apply to all orders placed through the bibica.eu online shop between Vlad Radu, Birnenstr. 8, 06179 Teutschenthal ("Seller") and consumers and business customers ("Customer").
§ 2 Contracting party The purchase contract is concluded with: Vlad Radu, trading as "Bibica", email: contact@bibica.eu.
§ 3 Formation of contract The product listings in the shop do not constitute a binding offer, but an invitation for the customer to place an order. By completing the checkout process, the customer submits a binding offer to purchase. The seller may accept this offer within 3 business days by sending an order confirmation or by delivering the goods.
§ 4 Prices and shipping costs All prices are final prices. Under § 19 UStG (small-business VAT exemption), no VAT is charged or separately itemized. Shipping costs are shown before the order is completed at checkout and depend on destination and order value.
§ 5 Payment Payment is made via Shopify Payments, including credit card (Visa, Mastercard, American Express, Maestro, UnionPay), Apple Pay, Google Pay, Klarna and Shop Pay.
§ 6 Delivery The separately published shipping policy applies. For consumer contracts, risk of accidental loss or damage passes to the customer only upon delivery to the customer, not upon handover to the carrier (§ 475(2) BGB).
§ 7 Retention of title Delivered goods remain the property of the seller until paid in full.
§ 8 Right of withdrawal for consumers
Withdrawal notice
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item of goods.
To exercise your right of withdrawal, you must inform us (email: contact@bibica.eu) of your decision to withdraw from this contract by a clear statement. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for supplementary costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day we receive notice of your withdrawal. We will use the same payment method you used for the original transaction unless expressly agreed otherwise. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is earlier.
You must return the goods without undue delay and in any case no later than fourteen days from the day you inform us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period expires. You will bear the direct cost of returning the goods.

Exclusions/premature expiry No exclusions apply. The right of withdrawal exists without restriction for all goods offered.
§ 9 Warranty Statutory warranty law applies. For new goods, the limitation period for defect claims is two years from delivery. For used goods (e.g. opened LEGO sets, used Pokémon cards), the same statutory two-year period applies; under current law it can only be shortened by an explicit, separate agreement with the individual consumer (not via blanket T&Cs), and no such shortening is made here. The condition of the goods (new/sealed, used, opened) is stated in the product title or description; this statement governs the condition agreed between the parties.
§ 10 Authenticity and condition of goods Collectible items are offered as genuine to the best of our knowledge, in accordance with the item description. For items with third-party certification (e.g. cards graded by an external company such as PSA), we pass on the certifying company's information (grading, certificate, serial number) as provided; we do not carry out our own additional authenticity or condition verification, particularly where we ourselves purchased the item already graded from a third party. This does not limit the customer's statutory warranty rights: if an item does not match its description (e.g. incorrect or inconsistent certification), the statutory warranty rights under § 9 apply unchanged.
§ 11 Liability The seller's liability is unlimited for intent and gross negligence, under the Product Liability Act, and for injury to life, body, or health. For slightly negligent breach of material contractual obligations, liability is limited to foreseeable, contract-typical damage. Liability for slightly negligent breaches is otherwise excluded.
§ 12 Dispute resolution The seller is not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board under § 36 VSBG.
§ 13 Governing law and jurisdiction German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent it does not deprive them of protections under the mandatory law of their country of habitual residence. Consumers may always bring claims before the courts of their own place of residence.
§ 14 Severability Should any provision of these T&Cs be or become invalid, the validity of the remaining provisions is unaffected.
